The government is facing mounting public criticism and accusations of executive overreach following reports that activities linked to the construction and operationalization of a United States-backed Ebola response facility at Laikipia Air Base have continued despite a High Court order suspending the project.
The controversy has intensified an already heated national debate surrounding the proposed facility, with critics alleging that the continued movement of personnel and equipment at the military installation amounts to a disregard of judicial authority and constitutional principles.
The High Court recently issued conservatory orders halting implementation of the project pending the hearing of a petition challenging the agreement between Kenya and the United States. The case was filed amid concerns over public participation, parliamentary oversight, environmental safety, and the broader implications of hosting a specialized Ebola response facility within the country.
Reports suggesting that preparations at the air base have continued despite the court order have sparked outrage among sections of the public, civil society groups and political leaders, who argue that compliance with court directives is fundamental to the rule of law.
The allegations have fueled fresh scrutiny of the government’s handling of the project, which has remained at the center of public discourse since details of the proposed facility emerged. Opponents contend that any activity associated with the project should cease until the court determines the legality of the agreement and the procedures used in its approval.
Government officials, however, have maintained that the facility is intended to strengthen Kenya’s public health preparedness and emergency response capabilities in the face of growing regional disease threats. Although Kenya has not reported any confirmed Ebola cases, health experts have emphasized the need for preparedness measures due to the country’s strategic position as a regional transport and trade hub.
The dispute has also attracted political attention, with lawmakers demanding greater transparency regarding the agreement, its funding arrangements, and the role of foreign partners in the project. The Parliamentary Health Committee is expected to continue its review of the matter as concerns over accountability and public participation persist.
Meanwhile, healthcare workers and professional associations have continued to raise questions about safety protocols, infrastructure readiness and the potential impact of the facility on Kenya’s health system. Some unions have warned of possible industrial action if their concerns are not adequately addressed.
As the court case proceeds, the controversy is increasingly being viewed as a test of the relationship between the Executive and the Judiciary, with legal experts emphasizing the importance of respecting court orders regardless of the policy objectives involved.
The matter is expected to remain under intense public scrutiny ahead of the scheduled court proceedings, which could determine the future of the Laikipia Ebola response facility and clarify the legal obligations of all parties involved.
