Gachagua Faults IEBC Chairperson Erastus Ethekon Over Consistency in Applying Electoral Laws

Former Deputy President Rigathi Gachagua has criticised Independent Electoral and Boundaries Commission (IEBC) Chairperson Erastus Ethekon, calling on the electoral commission to apply election laws consistently and impartially across all by-elections in the country.

Speaking during a political meeting, Gachagua argued that the credibility of the IEBC depends on its ability to enforce the law fairly, without favouring any political party or candidate. He said the commission must demonstrate independence by ensuring that similar electoral offences attract the same response regardless of who is involved.

According to Gachagua, selective enforcement of electoral regulations risks undermining public confidence in the commission and could cast doubt on the credibility of future elections.

“The IEBC must apply the law equally in every by-election. There should be no double standards or selective enforcement based on political interests,” he said.

The former Deputy President questioned what he described as inconsistencies in the commission’s handling of electoral matters, urging Chairperson Erastus Ethekon to ensure that all by-elections are conducted under the same legal standards and procedures. He maintained that every political player should enjoy equal treatment before the law.

Gachagua further stated that the commission has a constitutional obligation to remain neutral and independent, adding that fairness in the management of by-elections is essential in safeguarding Kenya’s democratic process.

He also challenged the IEBC to strengthen transparency in its decision-making, saying consistent application of electoral laws would help eliminate perceptions of bias and enhance public trust in the institution.

The remarks come at a time of heightened political activity ahead of a series of by-elections, with various parties intensifying campaigns and closely monitoring the conduct of the electoral agency. The upcoming mini-polls are expected to serve as an early test for the reconstituted IEBC under Chairperson Erastus Ethekon.

Gachagua reiterated that free, fair, and credible elections can only be achieved when electoral laws are enforced uniformly, warning that any perception of unequal treatment could weaken confidence in the country’s electoral system ahead of the 2027 General Election.
